Terms of Service

These Terms of Service ("Terms") govern your access to and use of getfaind.com and www.getfaind.com (the "Website"), app.getfaind.com (the "App"), and the related services described below (together, the "Services"), all provided by leif ventures UG (haftungsbeschränkt), Karl-Marx-Str. 250, 12057 Berlin, Germany, registered in the Commercial Register of the Amtsgericht Charlottenburg under HRB 170145 B and represented by Leif Pritzel ("FAIND", "we", "us", "our"). The Services are directed exclusively at businesses (B2B); they are not offered to consumers within the meaning of § 13 BGB. By registering for, ordering, or otherwise using the Services, you ("Customer", "you") agree to these Terms. Your own general terms and conditions do not apply, even if we do not expressly object to them.

1) Scope of Services

FAIND is a B2B AI-visibility service (Generative Engine Optimization, "GEO"). It helps you understand and improve how your brand appears in AI systems such as ChatGPT, Claude, Perplexity and Google AI Overviews. The Services consist of the following components; the specific components available to you depend on the plan you order:

  • The App and Platform. A web application at app.getfaind.com through which you order plans, manage your domain, and access your reports and Knowledge Graph.
  • AI Visibility Report ("Measure"). A report that analyzes how often your brand appears in AI systems, generated from publicly available information about your domain and content. Reports may be delivered as a one-time audit or on a recurring (e.g. monthly) basis depending on your plan.
  • Knowledge Graph / shadow site ("Improve"). An AI-optimized, static copy ("Knowledge Graph" or "shadow site") of your publicly available web pages. It is hosted on a subdomain of your own domain via a CNAME record, or on a subdomain that FAIND provides, and served through a content delivery network (CDN). Its purpose is to make your public content more accessible to AI systems and AI crawlers.
  • The FAIND snippet. A single line of JavaScript that you embed on your own website, of the form <script async src="https://app.getfaind.com/geo/snippet.js.php?d=DOMAIN_ID&t=TOKEN"></script>. In plain terms, the snippet detects when your page's content changes so that the Knowledge Graph stays current, and it measures AI-driven visits to your pages on an aggregated basis. The snippet is loaded asynchronously and non-blockingly, does not read form inputs or user-entered data, loads no third-party tags, and — as confirmed by our code audit — stores nothing on and reads nothing from the visitor's device (no cookies, no localStorage, sessionStorage, or IndexedDB, and no device or browser fingerprinting). The script is served in the open and can be read. A plain-language description is set out in the snippet documentation (Snippet Documentation) and snippet privacy note (Snippet Data Statement).

We may add, modify, or discontinue features over time. Material reductions to a paid plan's core functionality are addressed in Section 13.

2) Eligibility

The Services are available only to businesses, acting in the exercise of their trade, business, or profession, and to persons who are at least 18 years old and authorized to enter into these Terms on behalf of that business. By submitting a domain for an AI Visibility Report, connecting a domain to the Platform, or installing the snippet, you represent and warrant that you are authorized to represent that domain and its content and to permit the processing described in these Terms.

3) Account and Access

Using paid plans requires registration with a valid business email address. Login is provided by a magic link sent to that email address rather than a password.

  • Security: You are responsible for keeping access to your email inbox secure and for all activity carried out under your account. Notify us without undue delay if you suspect unauthorized access.
  • Suspension: We may suspend or restrict access in cases of suspected misuse, non-payment, security risk, or breach of these Terms. Where reasonable and lawful, we will give notice; suspension does not relieve you of accrued payment obligations.

4) Customer Responsibilities

You are responsible for your domain, your content, and the correct operation of the snippet on your site. In particular:

  • Accuracy and lawfulness: You remain responsible for the accuracy, lawfulness, and relevance of your content. You must not submit or expose unlawful, infringing, or confidential material, or data not intended for public access.
  • Permission to crawl and render: By connecting a domain or requesting a report, you confirm that you hold the rights and permissions for FAIND to crawl, fetch, analyze, render, mirror, and temporarily process the publicly available pages of that domain in order to provide the Services.
  • Robots and access rules: You are responsible for your robots.txt, meta-robots, and similar access rules. If you restrict crawling or rendering of pages that the Services need to access, functionality may be reduced or unavailable.
  • Correct snippet installation: Where your plan includes the Knowledge Graph, you are responsible for installing the snippet correctly and keeping it present and functional on the relevant pages.
  • Not blocking the snippet: You must not block, strip, or break the snippet — for example via a Content Security Policy (CSP), tag manager, or consent-management tool — where doing so prevents the snippet from functioning. Because the snippet stores nothing on and reads nothing from the visitor's device (see Section 1), it does not require a consent-banner entry to operate; a transparency note in your privacy policy is sufficient (see the Snippet Data Statement). If you nonetheless place the snippet behind a consent gate or restrictive CSP that disables it, the Knowledge Graph and related features may not work as intended, and we are not responsible for the resulting loss of functionality.

5) Intellectual Property and Use Restrictions

All intellectual property rights in the FAIND software, the App, the CDN, the structure and generated code of the Knowledge Graph / shadow site, the optimization logic, the reports, and all related materials belong to leif ventures UG or its licensors. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for your own business purposes during the term of your plan. Your underlying public content remains yours; we process it only to provide the Services.

You may not:

  • No scraping or self-hosting: scrape, copy, download in bulk, or self-host the Knowledge Graph, the shadow-site structure, or the optimization code outside the Services as provided;
  • No reverse engineering: reverse engineer, decompile, or attempt to extract source code or the underlying methods, except to the extent such restriction is prohibited by mandatory law;
  • No resale or sublicensing: resell, sublicense, rent, or provide the Services to third parties as a service bureau, except that agencies may use the Services on behalf of their clients under an agency plan or with our prior written approval;
  • No interference: interfere with, disrupt, or place undue load on the Services, or access them by automated means other than our documented interfaces;
  • No unlawful use: use the Services in violation of applicable law or third-party rights.

Customer reference / logo licence. You grant FAIND a revocable, non-exclusive, royalty-free licence to display your name and logo as a customer reference on the Website and in our marketing materials. You may withdraw this licence at any time by emailing legal@getfaind.com, and we will remove the reference within a reasonable time.

6) Payment and Plans

Prices and plan features are shown on our pricing page. Unless expressly stated otherwise:

  • Billing: Subscriptions are billed in advance for each billing period.
  • Auto-renewal: Subscriptions renew automatically for successive periods of the same length unless cancelled before the end of the then-current period (see Section 11).
  • Payment processing: Payments are processed by Stripe. We do not store full card details. For enterprise plans, payment by invoice and SEPA bank transfer is available on request.
  • Taxes: All prices are net of statutory VAT; for cross-border B2B supplies within the EU the reverse-charge mechanism may apply where you provide a valid VAT identification number. Any applicable statutory VAT and other taxes are added and are your responsibility.
  • Late payment: Overdue amounts may accrue statutory default interest, and we may suspend the Services after prior notice for non-payment. Our further statutory remedies remain unaffected.

7) Service Availability

The Services are provided "as is" and "as available". We use commercially reasonable efforts to keep the Services available, but we do not guarantee uninterrupted, timely, secure, or error-free operation. Availability may be affected by maintenance, updates, changes by third-party platforms (including AI systems, search engines, hosting, and CDN providers), network conditions, and events beyond our reasonable control.

Any availability figure that may be stated elsewhere (for example a "99.9%" target) is a non-binding target and not a warranted service level. We give no binding service-level agreement, and no service-level credits or other remedies attach to any such figure.

8) No Results or Ranking Guarantee

We do not warrant or guarantee any specific outcome, including any particular mentions, citations, rankings, recommendations, inclusion, or visibility in or by AI systems, generative engines, or search engines. Such outcomes depend on third-party systems and their models, policies, and algorithms, which are outside our control and may change at any time without notice. Nothing in the Services, the Website, or our marketing constitutes a promise of a specific result.

9) Feedback License

If you provide ideas, suggestions, or feedback about the Services, you grant FAIND a perpetual, worldwide, irrevocable, royalty-free license to use, copy, modify, and incorporate that feedback into our products and services without restriction or any obligation to you.

10) Data Protection

Our processing of personal data is described in our Privacy Policy. Where we process personal data on your behalf in providing the Knowledge Graph / Agentic Web CDN, we act as your processor under Art. 28 GDPR, and you act as the controller for your origin content, your robots.txt and access rules, and the lawfulness of exposing that content. The applicable data processing terms are set out in our Data Processing Agreement (Data Processing Agreement), which forms part of these Terms where such processing occurs. For an overview of what the snippet does and does not do with visitor data, see the Snippet Data Statement. Our data-retention periods — including that Knowledge Graph / shadow-site artifacts and change-detection signals are kept for the duration of the subscription and deleted or anonymized within 30 days after termination — are set out in full in our Privacy Policy.

11) Term, Termination and Effect

  • Cancellation: You may cancel a subscription at any time with effect at the end of the then-current billing period. Fees already paid for the current period are non-refundable unless required by mandatory law.
  • Termination by us: We may suspend or terminate the Services if you materially breach these Terms, fail to pay, or use the Services unlawfully. The right of either party to terminate for good cause (außerordentliche Kündigung) remains unaffected.
  • Effect on the Knowledge Graph: On termination or expiry, we will take down the shadow site / Knowledge Graph mirror. We will delete or anonymize the associated artifacts (for example the mirrored pages) and the associated change-detection signals within 30 days of termination. Other retention periods are set out in our Privacy Policy and in the DPA (Data Processing Agreement).
  • Your responsibilities on termination: You are responsible for removing the FAIND snippet from your own website. Removing the snippet does not delete data already lawfully processed; deletion is handled as described above and in the DPA.
  • Kill switch: We may deactivate or disable the snippet endpoints and the CDN delivery of your Knowledge Graph following termination. Disabling these endpoints causes the snippet to become a no-op and does not alter or damage your own website; your site continues to function independently of FAIND.

12) Warranties and Liability

To the extent permitted by law, and in addition to Sections 7 and 8, the following applies:

  • Disclaimer: Except as expressly stated in these Terms, we disclaim all implied warranties to the maximum extent permitted by law.
  • Unlimited liability: We are liable without limitation for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, and to the extent we have given a guarantee.
  • Slight negligence: For slight negligence (leichte Fahrlässigkeit), we are liable only where we breach an essential contractual obligation (Kardinalpflicht) — an obligation whose fulfillment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract.
  • Exclusion: Any further liability for slight negligence is excluded.
  • Data back-up: Because your underlying content originates from and remains on your own website, you are responsible for maintaining your own backups; our liability for loss of data is limited to the effort that would have been required to restore it had you kept appropriate backups.
  • Mandatory law: Liability under the German Product Liability Act (Produkthaftungsgesetz) and other mandatory statutory liability remains unaffected.

13) Changes to These Terms

We may amend these Terms for good cause (e.g. changes in applicable law, our Services, or relevant case law) by notifying you at least six weeks in advance by email. If you object before the change takes effect, either party may terminate the affected Services with effect from the effective date; if you do not object, continued use after that date constitutes acceptance. We will publish the updated Terms with a new "Last updated" date.

14) Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is Berlin, Germany.
